1. INTRODUCTION
1.1. The gym shall be known as HER SPACE, operated by HER SPACE KVD LTD (referred to as "Her Space", "the Gym", "we", "us" or "Management").
1.2. By purchasing, activating or using a Her Space membership, members agree to these Terms & Conditions and the Gym Rules.
1.3. Her Space is a dedicated women-only fitness facility designed to provide a comfortable, welcoming, private and supportive environment.
1.4. Management may amend these Terms & Conditions where reasonably necessary for legal, safety or operational reasons. Members will receive reasonable advance notice of material changes.
1.5. Her Space reserves the right to refuse or terminate membership where there is a lawful and reasonable justification, subject to the Equality Act 2010 and applicable consumer legislation.
1.6. Members must comply with instructions from authorised staff and all safety notices displayed throughout the premises.
2. WOMEN-ONLY MEMBERSHIP & ACCESS POLICY
2.1. Her Space operates as a single-sex fitness facility for women in accordance with the relevant provisions of the Equality Act 2010.
2.2. Our women-only environment has been established to support the privacy, dignity, modesty, safety, confidence and wellbeing of women.
2.3. For the purposes of the Equality Act 2010, the terms "sex", "woman" and "man" refer to biological sex, as interpreted by the Supreme Court in For Women Scotland Ltd v The Scottish Ministers [2025] UKSC 16.
2.4. Our women-only service is intended to operate under the single-sex service provisions in Schedule 3 of the Equality Act 2010, where the applicable legal conditions and proportionality requirements are met.
2.5. The legitimate aims of our women-only provision include:
-
Protecting women's privacy and dignity.
-
Providing a comfortable exercise environment.
-
Supporting women who feel uncomfortable exercising in mixed-sex gyms.
-
Accommodating religious and cultural requirements relating to modesty.
-
Encouraging women who might otherwise avoid gyms to participate in exercise.
-
Promoting the safety, confidence and wellbeing of members.
2.6. Her Space recognises the rights and protections afforded by the Equality Act 2010, including protections relating to sex, gender reassignment, disability, race, religion and belief.
2.7. Where an individual's eligibility for the women-only service requires consideration, Management will assess the circumstances sensitively and confidentially, taking account of the applicable law, the aims of the service and whether any reasonable alternative arrangements are available.
2.8. Any restrictions relating to transgender or non-binary individuals will be considered in accordance with the Equality Act 2010, the applicable statutory exceptions and proportionality requirements. Relevant decisions will not be based on harassment, stereotypes or assumptions about an individual's behaviour.
2.9. Management may request information reasonably necessary to determine eligibility where a legitimate question arises. Unnecessary, intrusive or humiliating verification procedures will not be used.
2.10. Her Space reserves the right to review its women-only policy in response to legislation, judicial decisions and guidance issued by the Equality and Human Rights Commission.
2.11. Although Her Space is a women-only gym, authorised male contractors, emergency services personnel and essential maintenance staff may occasionally require access. Where reasonably practicable, planned access will be communicated in advance and managed to protect members' privacy.
3. MEMBERSHIP REGISTRATION
3.1. All members must complete the required registration process before using the facilities.

-
An identification photograph for access and security purposes.
3.3. Members may be asked to provide suitable identification where reasonably necessary to verify their identity or eligibility.
3.4. Registering an online account without selecting and activating an eligible membership does not constitute an active gym membership.
3.5. Membership places, including limited Founders memberships, are not guaranteed until the required membership process has been completed and confirmation has been issued.
3.6. Memberships are personal, non-transferable and may not be shared with another individual.
3.7. Members must promptly update changes to their contact details or payment information.
4. MEMBERSHIP OPTIONS & ACCESS
4.1. Her Space may offer the following membership arrangements, subject to availability:
-
Her Space gym-only membership.
-
Her Space and Hybrid Club classes membership.
-
Combined Her Space, Elitefit and Hybrid Club membership.
-
Founders memberships and other promotional packages.
4.2. Each membership provides access only to the facilities and services expressly included in the selected package.
4.3. Access to Elitefit or Hybrid Club facilities is not automatically included with every Her Space membership.
4.4. Classes at the Hybrid Club, where included, are subject to class timetables, booking requirements, availability and the rules of that facility.
4.5. Her Space's women-only policy applies specifically to the Her Space premises. Elitefit and the Hybrid Club may operate as mixed-sex facilities.
4.6. Membership prices, payment frequency, any minimum commitment and additional charges will be explained before purchase and confirmed in the member's agreement.
4.7. Members wishing to change from one gym membership package to another may be required to pay a £10 administration fee, where this fee has been disclosed before the change is agreed.
4.8. A membership change does not automatically cancel any outstanding fees or existing contractual commitments.
4.9. Where a member's package includes multiple facilities, Management may make reasonable administrative arrangements between the relevant gym operators to provide access and administer payments.
5. FOUNDERS MEMBERSHIPS & EARLY ACCESS
5.1. Her Space may offer a limited number of promotional Founders memberships.
5.2. Founders memberships are subject to availability, published eligibility requirements and completion of the membership registration process.
5.3. The planned opening dates are:
-
Monday 16 November 2026: Early access for eligible existing female Elitefit members.
-
Tuesday 24 November 2026: Early access for eligible Her Space Founders members.
-
Tuesday 1 December 2026: General public opening.
5.4. Early access is available only once the member's applicable membership, payment arrangements and access requirements have been completed.
5.5. The membership billing date will be the date confirmed in the individual membership agreement. Early access does not automatically change that billing date.
5.6. Founders benefits, promotional prices, rewards or introductory personal training sessions are available only where expressly included in the particular offer purchased.
5.7. Founders memberships cannot be sold, transferred or assigned to another individual.
5.8. Any promise that a Founders membership price is fixed or protected will apply only for the period and under the conditions expressly stated in the relevant offer.
5.9. Management may end a Founders promotion once all available places have been allocated. Existing confirmed contractual benefits will be honoured.
6. MEMBERSHIP PAYMENTS & DIRECT DEBITS
6.1. Monthly memberships must be paid by the agreed payment method on the dates specified during registration.
6.2. Members are responsible for ensuring sufficient funds are available for their scheduled payments.
6.3. If a Direct Debit fails, the following may apply:
-
A £2.50 missed payment administration fee, where reasonably incurred and permitted by law.
-
Temporary suspension of gym access until the outstanding amount is resolved.
-
Contact from Management to arrange payment.
-
Reasonable recovery action if the debt remains unpaid.
6.4. If a member cancels their Direct Debit directly with their bank without first cancelling their membership in accordance with the required notice period, any valid outstanding membership fees remain payable.
6.5. A £10 administration charge may apply where unauthorised cancellation of a Direct Debit results in reasonable additional administrative work. This charge will not be imposed automatically where it is not justified or would be unlawful.
6.6. Members will not be charged multiple administration fees for the same administrative work.
6.7. Repeated missed payments may result in suspension or termination of membership following reasonable notice, where appropriate.
6.8. Any joining fee, access-fob fee or other additional charge will be clearly disclosed before the member agrees to pay it.
7. MEMBERSHIP CANCELLATION POLICY
7.1. Her Space operates a 30-day membership cancellation notice policy, subject to any clearly agreed minimum membership term and statutory cancellation rights.
7.2. Members wishing to cancel must notify Her Space using the designated online exit survey or by contacting Management in writing.
7.3. The cancellation notice period begins when a valid cancellation request is received.
7.4. Membership remains active during the notice period, and the member is responsible for fees properly payable for that period.
7.5. Members should not cancel their Direct Debit before the final payment has been confirmed.
7.6. Cancelling a Direct Debit through a bank does not, by itself, terminate the membership agreement. Members retain their legal right to cancel the payment instruction with their bank.
7.7. Her Space will confirm the cancellation and final membership date.
7.8. If a member has overpaid beyond the period for which fees are properly due, the relevant overpayment will be refunded.
7.9. Once the membership has ended, access to the gym and any linked facilities included in the cancelled package will cease.
7.10. No refunds will normally be given for periods during which a member voluntarily chooses not to use available facilities. This does not affect statutory rights or any entitlement arising from Her Space's failure to provide the contracted service.
8. ONLINE JOINING & 14-DAY COOLING-OFF PERIOD
8.1. Members who join online, by telephone or through another qualifying distance or off-premises agreement will normally have a statutory 14-day cancellation period beginning on the day the contract is entered into.
8.2. During this period, a member may cancel without providing a reason.
8.3. Where the member expressly requests that access begins during the cooling-off period and then cancels within that period, Her Space may charge a lawful and proportionate amount for services already provided, where the applicable legal requirements have been met.
8.4. Any remaining refundable amount will be returned in accordance with applicable consumer legislation.
8.5. The cooling-off period is distinct from the membership's normal 30-day cancellation policy.
8.6. Members may exercise their statutory cancellation rights by providing a clear cancellation statement to Her Space using its published contact details.
9. MEMBERSHIP FREEZES & EXCEPTIONAL CIRCUMSTANCES
9.1. Memberships cannot normally be frozen simply because a member is on holiday, is temporarily busy or chooses not to attend.
9.2. Her Space recognises that exceptional circumstances may prevent a member from exercising.
9.3. Requests for suspension or early cancellation will be considered reasonably and fairly where circumstances include:
-
Significant illness or injury.
-
A medical condition preventing safe exercise.
-
Pregnancy-related circumstances.
-
Permanent relocation making attendance impractical.
-
Redundancy or serious financial hardship.
-
Another substantial change in personal circumstances beyond the member's control.
9.4. Supporting evidence may be requested where reasonably necessary, taking account of data protection and privacy requirements.
9.5. Management may offer a temporary freeze, an adjusted membership arrangement or cancellation without an unreasonable penalty, depending on the circumstances.
9.6. Nothing in this section removes a member's statutory rights.
10. 24-HOUR ACCESS & MEMBERSHIP FOBS
10.1. Her Space is intended to operate 24 hours a day, 7 days a week, including periods when staff are not present.
10.2. Members will be issued an approved access fob or other authorised access credential once their membership is activated.
10.3. Fobs and access credentials are for individual use only.
10.4. Members must not:
-
Share their access fob.
-
Permit an unauthorised person to enter behind them.
-
Allow non-members to use their membership.
-
Prop open or interfere with access doors.
-
Attempt to bypass the gym's security system.
10.5. Unauthorised entry or sharing an access fob is considered a serious breach of membership conditions.
10.6. Members must report lost or stolen fobs immediately.
10.7. A reasonable replacement fee may apply, with the amount confirmed before a replacement is issued.
10.8. Access may be temporarily disabled where payments are overdue, membership has expired, or a serious safety or security concern requires investigation.
10.9. Staff may not be present during all opening hours. Members must exercise responsibly and follow the gym's emergency procedures.
10.10. Access may occasionally be interrupted due to emergencies, essential maintenance, power failures or other circumstances beyond our reasonable control. Her Space will take reasonable steps to restore access and communicate significant interruptions.
11. HEALTH, SAFETY & FITNESS TO EXERCISE
11.1. Members are responsible for exercising within their abilities and following reasonable safety instructions.
11.2. Members must complete any required health screening or Physical Activity Readiness Questionnaire (PAR-Q) accurately before using the facilities.

11.4. Members should inform Management confidentially of any health-related information reasonably necessary for safe participation or suitable adjustments.

11.6. Members must not use the facilities while under the influence of alcohol or recreational drugs.

12.5. Deliberate damage, reckless equipment misuse or repeated disregard of safety instructions may result in membership suspension or termination.
12.6. Where a member causes damage deliberately or negligently, Her Space may seek recovery of reasonable repair or replacement costs to the extent permitted by law.
12.7. Management may temporarily remove equipment from use for inspection, cleaning, maintenance or repair.
12.8. Members should not use equipment displaying a fault notice or equipment they reasonably believe is unsafe.

15.2. Where CCTV is in operation, appropriate signage and privacy information will be provided.

17.5. Personal training is a separate service unless expressly included within a particular membership promotion.
17.6. Where promotional personal training sessions are included, the relevant offer will state the number of sessions, booking arrangements and any reasonable expiry period.
